The series, So You Thought You Knew Healthcare Privacy…, is a relaxed but frank discussion about the current state of healthcare privacy, how we got here, and what the future could hold. It is hosted by founding partner Harry Nelson and attorney Adella Katz. This webinar series session – “California Calling: How States are Closing the Federal Gap in Consumer Healthcare Privacy” – explores how individual states have taken on the burden to fill in privacy gaps the federal government has been unable to or unwilling to fill. Inspired by the European privacy regime, California has paved the way for other states to develop comprehensive state-wide privacy schemes to protect all types of information, including protections for healthcare-specific information too controversial for the federal government to tackle. We explore why the burden to protect consumer information has shifted so massively to the states in light of the growing presence of the FTC, and how this shift helps us predict the future of state-directed healthcare privacy.
