In its role of monitoring distribution of pharmaceutical controlled substances and preventing diversion and abuse of these drugs, the Drug Enforcement Agency (DEA) has ramped up its scrutiny of medical providers who prescribe, administer or dispense controlled substances. Many states are also increasing enforcement efforts in this area. As a consequence, providers and their counsel must be prepared for audits and investigations conducted by the DEA or state Attorneys General.
It is imperative that providers comply with both federal and state regulations and be sensitized to high risk areas. Failure to do so, whether negligent or intentional, could result in penalties, including fines, being stripped of the providers’ ability to lawfully prescribe controlled substances, or criminal prosecution.
DEA regulatory issues are often given too little attention by healthcare attorneys. It is critical for counsel and providers to understand the risk issues, have best practices and policies and procedures in place, and be prepared to take the corrective steps to ensure federal and state law compliance and mitigate damages.
