Nelson Hardiman Negotiates Settlement with the California Department of Alcohol and Drug Programs (ADP)

Nelson Hardiman successfully negotiated a settlement with the California Department of Alcohol and Drug Programs (ADP) for a Southern California narcotics treatment program. ADP had suspended the operations of the program and transferred its clients away based, among other things, a whistle-blower complaint and allegations of noncompliance with numerous operational requirements. “The settlement was the product of building trust and credibility with the Department,” said Nelson Hardiman partner Harry Nelson. “The challenge is how to convey that our client was serious about its intention to operate in strict compliance with the law.” In connection with the settlement, the treatment program agreed to adopt a compliance plan incorporating safeguards that align with best practices in the addiction treatment industry. Under the terms of settlement, the program will reopen shortly, subject to a 3-year probation, upon approval of new protocols and a new medical director.
