Nelson Hardiman lawyers successfully overturned a temporary withhold imposed by the Medi-Cal Program on a home health provider. As a result of the fact that current law does not require an in-person hearing, providers often face an uphill battle in appealing the California Department of Health Care Services’ withholds, which freeze reimbursement funds, and suspensions, which prevent future reimbursement. Nonetheless, Nelson Hardiman submitted written evidence that persuaded a Medi-Cal hearing officer that there was no basis for the withhold to remain in place against its client, a home health care agency that serves children with disabilities.
